We like to conduct our business on the basis of trust and that works 99.9% of the time, however to protect ourselves and our customers there have to be some formal rules. The key conditions of hire are detailed in clauses 1 - 6 below, and the below that are the formal conditions of hire which all hirers are requested to agree to.

 

Key Conditions

  1. Bookings will be confirmed on receipt of a 1/3rd Deposit. Telephone bookings will be held for 10 days.

  2. The balance must be paid no less than I month before entry. Cottages can are let from 3 pm Saturday and must be vacated by 10 am Saturday.

  3. Cottages are let for the number of people specified at the time of booking. 

  4. All breakages and losses incurred during the tenancy are the responsibility of the tenants.

  5. Bookings cancelled within 60 days of the let are subject to the full letting charge unless re-let when an administration fee only will be charged.

  6. No responsibility whatsoever is accepted by the proprietors of Tigh Cargaman or their staff for any injury or damage sustained to any person or their property whilst resident at Tigh Cargaman.

Hire Agreement

1.       The hirer warrants that the subjects let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, "a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday."

2.       The hirer shall not sub-let the premises or any part thereof.

3.       The number of people occupying the premises shall not exceed the number stated for the premises, except by prior agreement in writing with the lessor.

4.       The Hirer binds and obliges herself/himself to vacate the hired premises without demand at the termination of the period of hire.

5.       The Hirer binds and obliges herself/himself to pay to the lessor in respect of any loss or damage beyond fair wear and tear.

6.       Cancellation The Hirer may be liable for the total hire charge unless 60 days written notice is sent by recorded delivery to the lessor. In the event that cancellation is made less than 60 days from the commencement of the hire, the Hirer agrees that, while every effort will be made by the lessor to re-let, if a substitute cannot be found, the Hirer will be responsible for paying for the period of tenancy booked.

7.       The lessor may treat the booking as cancelled if the balance of the payment is not received four weeks before the hire is due to commence, and every effort will be made to re-let the vacancy.

8.       The Hirer shall undertake to prevent any member of his party from causing a nuisance or disturbance to other residents or occupiers.

9.       The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let.

10.   The Hirer undertakes to relieve the lessor from any liability for damage or injury however caused by any member of her/his party.

11.   The Lessor, his agents or employees, accept no responsibility for loss, injury or damage to any member of the Hirer's party or their property, howsoever caused, arising in any manner out of the let of the premises.
